Terms of Service

These Terms govern your use of Crim Report, operated by Crim Report Inc., a New York corporation ("Crim Report," "we," "us," "our"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
Crim Report is a unified incident reporting system for the motor carrier and logistics industry. Authorized users — including motor carriers, freight brokers, factoring companies, insurance providers, and other industry participants — can search public motor carrier records, submit and view user-generated incident reports, and access additional tools through tiered plans.
Crim Report is an information service. We do not provide legal, financial, credit, insurance, employment, or business decision advice. You make all decisions based on information from the Service at your own risk.
2. Not a Consumer Reporting Agency
CRIM REPORT INC. IS NOT A CONSUMER REPORTING AGENCY UNDER THE FAIR CREDIT REPORTING ACT (15 U.S.C. § 1681 ET SEQ.) OR ANY ANALOGOUS STATE LAW. INFORMATION FROM THE SERVICE IS NOT A "CONSUMER REPORT" AND YOU MAY NOT USE IT FOR ANY FCRA-COVERED PURPOSE, including but not limited to: eligibility for personal credit or insurance; employment, hiring, or retention decisions; tenant or housing screening; or any other purpose regulated by the FCRA or state consumer-reporting laws.
If you misuse the Service in violation of this Section, you do so at your own risk and you indemnify us under Section 14.
3. Eligibility and Account
You must be at least 18 and have legal capacity to contract. You must register an account with accurate information, safeguard your credentials, and notify us at support@crimreport.com of any unauthorized access. You are responsible for all activity on your account.
4. Plans, Billing, and Cancellation
Plans and pricing. The Service is offered in tiered plans described on our site. We may change features and pricing prospectively; changes do not affect a current paid period. Subscriptions auto-renew unless canceled before the next cycle.
Payment. By providing a payment method, you authorize us and our payment processor to charge it for all fees due. Failed payments may result in suspension or termination.
Failed payments. If a payment fails, we may attempt to recharge your card. If we are unable to collect payment after 7 days, your subscription will end and your access will revert to the free tier.
Cancellation. You can cancel any active subscription at any time through your account settings or by emailing support@crimreport.com. After cancellation, your access continues through the end of the current paid period, and we stop charging you at renewal. Billing cycles are not pro-rated mid-period.
One-time purchases. Prepaid seats, invite credits, and validation packs are activated when the associated service is delivered.
Billing disputes. If you believe there's a billing error or you experienced a material service failure, contact support@crimreport.com before initiating a chargeback. We resolve confirmed billing errors directly and may issue refunds in those cases at our discretion.
Terminations for convenience. If we terminate your account under Section 5.2 while you have prepaid time remaining, we will either continue your access through the paid period or issue a pro-rated refund — our choice.
5. Termination
5.1 For cause. We may suspend or terminate your account immediately if you breach these Terms, use the Service for any prohibited purpose, post unlawful or defamatory content, engage in fraud or abuse, or fail to pay.
5.2 For convenience. We may suspend or terminate your account, or discontinue the Service in whole or part, at any time on seven (7) days' notice (which may be by email). If you have unused prepaid time at termination, you receive the remedy in Section 4.
5.3 By you. You may cancel at any time through account settings or by emailing support@crimreport.com. Cancellation stops future billing; access continues through the end of the current paid period.
5.4 Survival. Sections 2, 4, 6.4, 7 through 18, 21, 22, and any other provision that by its nature should survive, will survive termination.
6. User Content
6.1 Your responsibility. You are solely responsible for content you submit — incident reports, comments, documents, files, and any other material (collectively, "User Content"). By submitting it, you represent that it is truthful and accurate to the best of your knowledge; that you have authority to submit it; that it contains no knowingly false statements about any person or entity; and that it does not violate any law or third-party right.
6.2 License to us. You grant Crim Report Inc. a non-exclusive, worldwide, royalty-free, sublicensable, perpetual, and irrevocable license to use, host, store, display, distribute, and make available your User Content in connection with operating, providing, and improving the Service.
6.3 We don't author or endorse. Crim Report Inc. hosts User Content; we do not author, verify, or endorse it. We are not the publisher or speaker of User Content within the meaning of Section 230 of the Communications Decency Act, 47 U.S.C. § 230. User Content reflects the views of the user who submitted it.
6.4 Moderation. We may, but are not required to, review, edit, refuse to display, remove, or restrict access to any User Content at any time, with or without notice, for any reason.
6.5 Dispute review. If you are the subject of User Content on the Service and believe a specific item contains a material factual inaccuracy, you may submit a written dispute to privacy@crimreport.com and CC support@crimreport.com. Identify the specific item, identify what you believe is inaccurate, and provide supporting documentation. We may, at our discretion, review submissions and, in our sole discretion, contact the submitting user, request additional information, annotate, remove, or take no action. Review is informal, undertaken without obligation, and our determination is final.
7. No Carrier Selection, Recommendation, or Endorsement
The Service provides motor carrier information, public regulatory data, and user-submitted incident reports to support your independent vetting and decision-making process. Crim Report Inc. does not select, recommend, endorse, approve, or disapprove any motor carrier, broker, shipper, factoring company, insurance provider, or other entity. Any data, signal, badge, label, or output produced or displayed by the Service is an analytical representation of public information and user submissions — not a recommendation, certification, or guarantee of safety, fitness, authority, financial condition, or operational quality.
The decision to engage, hire, dispatch, contract with, factor, insure, or otherwise transact with any entity is solely yours. You are solely responsible for that decision and for compliance with all duties of care, regulatory obligations, and laws applicable to you. Crim Report Inc. is not affiliated with, endorsed by, or operated on behalf of the Federal Motor Carrier Safety Administration or any other government agency.
8. Acceptable Use
You agree not to, and not to allow any third party to:
- Use the Service for any unlawful purpose, including any FCRA-covered use (Section 2);
- Scrape, crawl, harvest, or extract data by automated means without our written consent;
- Resell, redistribute, sublicense, or commercially exploit the Service or its data without our written consent;
- Submit User Content that is false, defamatory, harassing, threatening, obscene, unlawful, or infringing;
- Use the Service to extort, coerce, intimidate, or retaliate against any person or entity;
- Use multiple accounts to evade limits, suspensions, bans, or fee obligations;
- Reverse-engineer, decompile, or attempt to derive the source code of the Service;
- Interfere with or disrupt the Service or attempt unauthorized access;
- Use the Service or its data to develop or train any machine-learning model, AI system, or competing product without our written consent;
- Misrepresent your identity, affiliation, or authority.
9. Intellectual Property
The Service, including all software, design, text, graphics, logos, and the look and feel, is owned by Crim Report Inc. or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes under these Terms. No other rights are granted. "Crim Report" and the Crim Report logo are our trademarks and may not be used without written consent.
10. Third-Party Data and Services
The Service incorporates data and services from third parties, including the FMCSA, state Secretary of State offices, payment processors, and others. Third-party data is provided as it reaches us and may be incomplete, inaccurate, outdated, or unavailable. We make no representation or warranty about third-party data or services and are not liable for their errors, omissions, downtime, or changes.
11. Future Features
We may introduce new features at any time, including analytical or automated tools. New features may be subject to additional or revised terms, which we will provide before you access them.
12. Disclaimer of Warranties
THE SERVICE AND ALL DATA AND CONTENT MADE AVAILABLE THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, TIMELINESS, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or error-free, that data displayed is accurate or current, or that the Service is free of harmful components. You use the Service at your own risk.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRIM REPORT INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, GOODWILL, OR REPUTATION, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, ON ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE FEES YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Without limiting the foregoing, in no event will Crim Report Inc. be liable for any bodily injury, property damage, cargo loss, business loss, or damages of any kind arising from any accident, incident, theft, fraud, double-brokering, identity theft, regulatory action, or other event involving any motor carrier, broker, shipper, driver, factoring company, insurance provider, or other entity researched, monitored, displayed, or surfaced through the Service. Liability for such events rests with the parties to the underlying transaction or event, not with Crim Report Inc.
These limits apply even if a remedy fails of its essential purpose. Some jurisdictions limit these exclusions, in which case our liability is limited to the maximum extent permitted by law.
14. Indemnification
You will defend, indemnify, and hold harmless Crim Report Inc. and its officers, directors, employees, agents, affiliates, and licensors from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use of the Service; (b) your User Content; (c) your breach of these Terms, including Section 2 (FCRA) and Section 8 (Acceptable Use); or (d) your violation of any law or third-party right.
Without limiting the foregoing, you specifically agree to indemnify, defend, and hold harmless Crim Report Inc. from any third-party claim — including but not limited to claims for negligent hiring, negligent selection, negligent entrustment, or vicarious liability — arising from your selection of, contract with, or business relationship with any motor carrier, broker, shipper, driver, factoring company, insurance provider, or other entity, regardless of whether you used data or information from the Service in connection with that selection or relationship.
We may, at our expense, assume exclusive defense and control of any matter subject to indemnification, and you will cooperate.
15. Legal Process and Subpoenas
Crim Report Inc. may receive subpoenas, court orders, discovery requests, or other legal process relating to your use of the Service, including in connection with litigation involving you or counterparties you researched. You agree that: (a) we may comply with any such legal process without prior notice to you where prohibited by law or where we determine in good faith that notice is inappropriate; (b) where we do provide notice, we have no obligation to challenge or quash the process on your behalf; (c) you will reimburse us for our reasonable costs of compliance, including attorneys' fees and personnel time, incurred in responding to legal process arising from your use of the Service or to which you are a party; and (d) historical data, audit logs, account activity, and other records we maintain may be produced in response to such legal process.
16. Export Controls and Sanctions
You represent and warrant that (a) you are not located in, under the control of, or a national or resident of any country subject to a comprehensive U.S. embargo or other restrictive trade sanctions; (b) you are not identified on any U.S. government list of prohibited or restricted parties, including the U.S. Treasury Department's Office of Foreign Assets Control (OFAC) Specially Designated Nationals and Blocked Persons List or the U.S. Department of Commerce Denied Persons List or Entity List; and (c) you will not access or use the Service in violation of any U.S. export control or economic sanctions laws.
17. Dispute Resolution; Arbitration; Class Action Waiver
PLEASE READ — THIS AFFECTS YOUR LEGAL RIGHTS.
17.1 Informal first. Before filing any claim, send written notice to legal@crimreport.com. We will attempt good-faith resolution within thirty (30) days.
17.2 Binding arbitration. Any dispute not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, before a single arbitrator in New York County, New York. Judgment on the award may be entered in any court of competent jurisdiction.
17.3 Class action waiver. YOU AND CRIM REPORT INC. AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims or preside over class proceedings.
17.4 Exceptions. Either party may bring an action in court (a) for injunctive relief to protect intellectual property, account credentials, or the integrity of the Service, or (b) in small-claims court for claims within that court's jurisdiction.
17.5 Opt-out. You may opt out of arbitration by sending written notice to legal@crimreport.com within thirty (30) days of first agreeing to these Terms, including your name, account email, and clear statement of intent to opt out.
18. Governing Law
These Terms are governed by New York law, without regard to conflict-of-laws principles. Subject to Section 17, the exclusive venue for any judicial action is the state or federal courts in New York County, New York, and you consent to personal jurisdiction there.
19. Changes to These Terms
We may update these Terms. When changes are material, we will update the "Last Updated" date and provide notice through the Service, by email, or by other reasonable means. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service and cancel your account.
20. General
These Terms, together with the Privacy Policy, are the entire agreement between you and Crim Report Inc. If any provision is unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign freely. Notices to us go to legal@crimreport.com; notices to you may be sent to your account email or posted in the Service. We are not liable for failures caused by events beyond our reasonable control. These Terms do not create any agency, partnership, joint venture, or employment relationship.
21. Identity Verification (CrimCheck)
Some features of the Service — including CrimCheck driver and pickup verification — let an authorized user (such as a broker) request that a driver verify their identity before freight is released. These features involve the capture and processing of identity documents and biometric data (facial images and liveness), performed on our behalf by a third-party identity-verification provider. How that data is handled is described in Section 15 of the Privacy Policy.
- If you request a verification (for example, as a broker or shipper), you represent that you have a legitimate business purpose for it, that you have provided any notices and obtained any consents required of you by law, and that you will use the results only to make your own independent decision about releasing freight, in compliance with all applicable laws (including biometric-privacy, identity-verification, and anti-discrimination laws). You will not use verification results for any FCRA-covered purpose (Section 2).
- If you are asked to verify (for example, as a driver), participation is voluntary and requires your explicit consent before any data is captured; if you decline, the verification will not proceed. How your data is handled is described in our Privacy Policy.
- No guarantee. A verification result — including any "release," "review," "call broker," or "do not release" output — is an analytical aid based on the information available at the time. It is not a certification or guarantee of identity, authority, or fitness, and the decision to release freight remains solely yours under Section 7.
- Processing. Verification is performed by a third-party provider acting as our service provider; we remain responsible for our processing of identity and biometric data as described in the Privacy Policy.
22. Operational Communications with Drivers and Shippers
This Section covers operational messages we send by SMS (text message) and by email in connection with our CrimCheck product (Section 21), to drivers and shipper contacts who are not directly Crim Report account holders.
22.1 Sender and channels. SMS messages sent by Crim Report Inc. originate from a US toll-free number registered to Crim Report Inc.; sender identifier "CRIM Report" appears at the start of every message. Email messages are sent from a crimreport.com sender address.
22.2 Purpose and content. Communications under this Section are strictly transactional and operational. In connection with a specific dispatched load, we may send:
- Driver identity verification link. A one-time SMS and/or email to the driver assigned to the pickup, containing a secure link for the driver to complete identity verification (government-ID capture, face-match, liveness) before arrival at the shipper's location.
- Pickup verification link. A one-time SMS and/or email to the shipper contact around the scheduled pickup time, containing a secure link to complete the driver's face-verification at the dock.
- Process updates. Reminders, retry links (up to two additional if the first attempt fails, expires, or is abandoned), and pickup-time instructions related to the same session.
We do not send marketing, promotional, or advertising messages under this Section. We do not send recurring subscriptions, newsletters, or product announcements to these recipients. Every message is tied to a specific dispatched load.
22.3 How consent is obtained. Recipients under this Section have not directly opened an account with us. Consent is obtained through the operational-relationship chain standard in the US freight-brokerage industry:
- A licensed freight broker (our paying customer) dispatches a specific load to a specific motor carrier under an active commercial contract.
- The carrier's dispatcher assigns a specific driver to that load. The driver, by accepting the load, is a professional operator expected to receive operational communications from parties in the transaction chain.
- The dispatcher or carrier provides the driver's mobile number (and, where available, email address) to the broker as standard load-dispatch practice.
- Before initiating a CrimCheck, the broker must affirmatively confirm on our platform that they have obtained the driver's consent (directly or via the carrier / dispatcher) to be contacted by SMS and email about the specific pickup and the related identity-verification process. This confirmation is stored with the initiating user, timestamp, and load context.
Recipients may opt out at any time under Section 22.5.
22.4 Message frequency and rates. One SMS and/or email per verification session, plus up to two retries. Standard message and data rates may apply to SMS; you are responsible for any charges from your mobile carrier.
22.5 Opt-out. You may opt out at any time. SMS: reply to any message from us with any of the following keywords — STOP, STOPALL, CANCEL, END, QUIT, UNSUBSCRIBE, OPTOUT, REVOKE. Once you opt out, you will not receive any further SMS from any Crim Report campaign to that number. To resume, reply START to a previous message from us. Email: every message includes an unsubscribe link, or you may email support@crimreport.com to opt out. Opt-out is honored per channel; opting out of one channel does not automatically opt out of the other unless requested.
22.6 Help. Reply HELP to any SMS from us, or email support@crimreport.com, to receive our support contact and a link back to this Section.
22.7 Data handling. Mobile numbers and email addresses processed under this Section are used solely to send the operational communications described in Section 22.2 and are subject to our Privacy Policy. Contact details on opt-out are retained only for the purpose of honoring the opt-out and are not used for any other purpose.
22.8 Warranty by the initiating party. By initiating a CrimCheck through the Service (whether directly or via API), you represent and warrant that (a) you have obtained the recipient's consent to receive the operational SMS and email described in this Section — either directly or through your commercial relationship with the recipient's carrier or dispatcher — and (b) all information you provide to us (including the recipient's mobile number and email address) is accurate and lawfully obtained. You agree to indemnify us under Section 14 for any breach of this warranty.
